1. About Edithly

Edithly is an AI-powered document visualisation platform developed and operated by Smazee Apps, an ABN-registered business based in Melbourne, Australia. By using Edithly, you enter into a binding agreement with Smazee Apps.

2. Acceptance of Terms

By creating an account or using the Edithly service, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the service.

You must be at least 13 years old to use Edithly. If you are under 18, you confirm that a parent or guardian has consented to these terms on your behalf.

3. The Service

Edithly allows users to upload documents (PDFs, URLs, text, and other supported formats) and receive AI-generated outputs including visualizations, summaries, flashcards, concept maps, audio, and other learning formats.

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice of material changes where possible.

4. Your Account

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Ensuring the information you provide during registration is accurate and current.

5. Acceptable Use

You agree not to use Edithly to:

• Upload content that is illegal, defamatory, infringing, or harmful to others.
• Attempt to reverse-engineer, scrape, or exploit the platform or its AI systems.
• Circumvent any usage limits, access controls, or security measures.
• Resell or redistribute outputs generated by Edithly without appropriate attribution.
• Upload documents containing sensitive personal data of others without their consent.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

6. Your Content & Data

You retain full ownership of the documents and content you upload to Edithly. By uploading content, you grant Smazee Apps a limited, non-exclusive licence to process that content solely for the purpose of delivering the service to you.

Your documents are stored as encrypted chunks on secured hosting infrastructure. Your data is used only for generating the outputs you request and for viewing your documents within the platform — never for advertising, model training, or any purpose beyond what you have explicitly initiated.

We do not train AI models on your data. Your content remains private and is never shared with third parties for their own use.

7. Security

We implement industry-standard security measures including encryption of data at rest and in transit, encrypted authentication credentials, and regular security reviews. However, no system is 100% secure. You use Edithly at your own risk and should not upload highly sensitive or classified documents.

8. Intellectual Property

All rights in the Edithly platform, brand, interface, and underlying technology are owned by Smazee Apps. You may not copy, reproduce, or create derivative works from the platform itself without our written permission.

AI-generated outputs produced from your documents are provided for your personal and professional use. You are responsible for verifying the accuracy of any AI-generated content before relying on it.

9. Disclaimer & Limitation of Liability

Edithly is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, uninterrupted, or that AI-generated outputs will be accurate or complete.

To the maximum extent permitted by Australian law, Smazee Apps shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including loss of data or reliance on AI-generated content.

10. Termination

You may delete your account at any time from within the app. On deletion, your documents and personal data will be permanently removed from our systems within 30 days.

We may suspend or terminate your account if you breach these terms, misuse the platform, or if we are required to do so by law.

11. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia. Any disputes arising from your use of Edithly shall be subject to the exclusive jurisdiction of the courts of Melbourne, Victoria.

12. Changes to These Terms

We may update these terms from time to time. Continued use of Edithly after changes are posted constitutes acceptance of the revised terms. We will notify you of material changes via email or in-app notice.
